These are the terms under which you use BothWant. They are written in English, not in Latin, because we would like you to read them.
What you're agreeing to.
When you create a BothWant account, you and BothWant, Inc. — a Delaware corporation — enter into this agreement. The agreement covers use of bothwant.com, our mobile web experience, and any related surface where you sign in with your BothWant account.
If you are using BothWant on behalf of an organization (for example, as a couples counselor recommending it to a client), you confirm that you have the authority to do so and that the organization is bound by these terms.
Your account.
You must be at least 18 years old. You are responsible for keeping your password private and for everything that happens in your account. If you suspect your account has been accessed without your permission, write to security@bothwant.com.
Each account belongs to one person. Couples each create their own account and link them through a partnership invite. Sharing a single account between two people defeats the architecture and we ask that you don’t.
Acceptable use.
You agree not to:
- —Use BothWant to coerce a partner into participating, or use the product in any context where consent is not freely given.
- —Reverse engineer the encryption layer with the goal of accessing another user's data; security research conducted in good faith and reported to security@bothwant.com is welcome.
- —Scrape the marketing site at a rate that disrupts service for other users.
- —Probe, attack, or attempt to compromise BothWant's infrastructure.
- —Use BothWant in violation of applicable law, including export-control law.
Subscription, billing, refunds.
BothWant offers three pricing options described at /pricing: a free tier, a monthly Premium subscription ($9.99/mo), and an annual Premium subscription ($79/yr). Pricing is subject to change with at least 30 days’ notice; existing subscriptions are not re-priced mid-term.
Refunds: if you are not satisfied within 14 days of a paid purchase, we refund you in full, no questions, no follow-up survey. Write to refunds@bothwant.com and we will process the refund within 7 business days. Refunds delete the corresponding access (you cannot keep a refunded Premium tier active).
Our intellectual property.
BothWant, the BothWant mark, the question library, and the editorial content on bothwant.com are owned by BothWant, Inc. We grant you a limited, non-exclusive, non-transferable license to use them for personal, non-commercial purposes — which is to say, for using BothWant the way it is intended to be used.
Your intellectual property.
Your answers are yours. We do not claim ownership over the encrypted blobs you submit, and we do not claim a license to them beyond what is necessary to operate the reveal function on your behalf. We will not use your answers to train AI models. (The architecture would not allow it; we have additionally committed to it in writing.)
Termination.
You can terminate your account at any time from /settings. Termination is hard-delete, as described in the privacy policy.
We can terminate your account if you materially breach these terms (for example, by using BothWant to coerce a partner). Where it is safe to do so, we will give you notice and a reasonable opportunity to cure. Where it is not — for example, if your account is being used to harm another user — we may terminate without notice.
Limitation of liability.
We have built this carefully. We will probably still mess up at some point. When we do, the limit of what you can recover from us is the amount you paid us in the previous twelve months — usually $79, sometimes $9.99, often zero. This is standard for software companies and we are not going to pretend it is anything else.
We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent allowed by law. To the extent your local law does not allow this kind of disclaimer, we apply the disclaimer to the maximum extent it does allow.
Disputes.
Most disputes can be resolved by writing to us. Most disputes are. If we cannot resolve a dispute that way, we agree to first attempt mediation in San Francisco, California, before either party files a lawsuit. This does not apply to small-claims matters, which can proceed directly.
These terms are governed by California law, without regard to conflict-of-laws principles.
Changes to these terms.
We will email you at least 30 days before any material change to these terms. Material means: anything that affects your data, your money, or your ability to use the product the way you have been using it.
Non-material changes (typo fixes, broken-link repair, address updates) we will make without emailing you, but we will note them in a changelog at /legal/changelog.
