Terms of Service

1. Acceptance of Terms

By accessing or using BothWant ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and BothWant ("we," "us," or "our").

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. Eligibility and Age Verification

The Service is intended exclusively for adults. By creating an account, you represent and warrant that:

• You are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater).
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited from using the Service under any applicable law.

We reserve the right to request age verification at any time and to suspend or terminate accounts where we have reasonable grounds to believe a user is under the minimum age requirement. Providing false age information is grounds for immediate account termination.

3. Account Registration and Security

To use the Service, you must create an account with accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized access or security breach.

Each individual may maintain only one account. Sharing accounts or credentials with third parties is prohibited.

4. The Service

BothWant provides a platform for romantic partners to discover shared desires through anonymous quizzes. The core functionality includes:

• Anonymous Quiz Responses: Each partner answers quiz questions independently. Individual responses are never revealed to the other partner.
• Mutual Match Reveals: Only desires where both partners independently express interest are revealed as a match. If only one partner selects a desire, neither partner is informed.
• Shared Bucket List: Matched desires can be added to a private shared list accessible only to the paired partners.

We do not guarantee uninterrupted or error-free operation of the Service. We may modify, suspend, or discontinue features with reasonable notice.

5. Privacy of Responses

We take the privacy of your quiz responses seriously. Our commitment:

• Your individual quiz answers are encrypted and are never visible to your partner, to other users, or to our staff.
• Only mutual matches (where both partners independently select the same desire) are revealed.
• We do not sell, share, or use your individual quiz responses for advertising or third-party purposes.
• Aggregated, fully anonymized data may be used to improve quiz quality and the Service. This data cannot be traced to any individual or couple.

6. User-Generated Content

Certain features may allow you to submit custom quiz questions, bucket list notes, or other content ("User Content"). By submitting User Content, you:

• Retain ownership of your content but grant us a limited, non-exclusive, royalty-free license to store, display, and process it as necessary to operate the Service.
• Represent that your content does not violate any law, infringe any third-party rights, or contain illegal material.
• Agree not to submit content that is abusive, threatening, harassing, or that promotes violence or illegal activity.

We reserve the right to remove User Content that violates these Terms without prior notice.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to access another user's account or private quiz responses.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use automated systems (bots, scrapers) to access the Service without written permission.
• Harass, intimidate, or coerce any person through or in connection with the Service.
• Use the Service to distribute spam, malware, or unsolicited communications.
• Impersonate another person or misrepresent your identity or affiliation.

8. Account Deletion and Data Rights

You have the right to delete your account at any time through your account settings. Upon account deletion:

• Your profile information, quiz responses, and personal data will be permanently deleted within 30 days.
• Shared bucket list items will be removed from both partners' views.
• Match history associated with your account will be purged.
• Anonymized, aggregated data that cannot identify you may be retained for analytical purposes.

9. Intellectual Property

The Service, including its design, features, quiz content, and underlying technology, is owned by BothWant and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written consent.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We are not a substitute for professional relationship counseling or therapy.

11. Limitation of Liability

To the maximum extent permitted by law, BothWant shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. Arbitration shall take place in Clark County, Nevada, unless both parties agree otherwise. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles.
